Paychex has launched a payroll tax penalty protection service for its payroll customers. The service is available to Paychex Flex customers.

The offering covers eligible payroll tax issues and provides financial protection for penalties and interest when Paychex cannot secure relief through its resolution work. Paychex will research issues and work directly with tax agencies on customers' behalf to seek corrections, abatements or appeals.

Paychex has long offered payroll tax notice research and resolution support. The new service expands that work by taking on eligible cases regardless of whether the underlying issue stems from a customer error, a tax agency error or another administrative problem.

Payroll tax notices can arise from processing mistakes by federal or state agencies, account discrepancies and other administrative issues. Paychex cited Internal Revenue Service data showing that more than 4.4 million employment tax penalty notices were assessed in 2025.

Broader support

The service is powered by WISE, Paychex's artificial intelligence system, which is built into its back-office payroll and tax operations. Paychex said the combination of automation and internal tax expertise allows it to manage eligible issues at scale rather than leaving businesses to handle them on their own.

The move also highlights how payroll providers are using artificial intelligence in internal operations tied to compliance and customer support, rather than only in customer-facing software. In this case, Paychex is applying the technology to payroll tax administration, where mistakes can create direct costs for employers.

For smaller businesses in particular, payroll tax disputes can absorb management time and disrupt cash flow if penalties and interest build up before a case is resolved. By handling eligible cases and, in some circumstances, covering remaining penalties and interest, Paychex is positioning the service as a way to reduce that burden.

Paychex serves about 840,000 customers and says it pays one in 11 private-sector workers in the United States. That scale gives the group a large flow of payroll and tax data, which it says supports the service and its wider payroll operations.

Executive comment

Frank Fiorille, Managing Vice President of Risk and Compliance at Paychex, said the company's work on payroll tax issues has evolved as its internal systems have developed.

"Payroll tax issues can divert valuable time and resources from running a business," said Frank Fiorille, Managing Vice President of Risk and Compliance at Paychex.

"Paychex has always worked to help customers address payroll tax issues, and AI innovation in our back office has evolved what we can offer our customers at scale. We now provide a real, outcome-based solution and stand behind it financially. Our advocates take on eligible payroll tax issues regardless of cause, and if penalties and interest remain after our resolution efforts, we cover them. Business owners get their time back, their cash flow protected, and real peace of mind," Fiorille said.

The service comes as employers face continued complexity in payroll administration across federal and state tax systems. Errors don't always stem from a missed filing or payment by the employer, and tax-agency disputes can take time to investigate and resolve.

By moving beyond notice support to a model that includes direct representation with agencies and limited financial backing for unresolved penalties and interest, Paychex is broadening the scope of payroll tax assistance within its platform. The service remains limited to eligible issues under its terms and is currently available only to customers using Paychex Flex.
